Steambot Terms & Conditions

1. APPLICATION OF TERMS AND CONDITIONS OF SALE

1.1
These Terms and Conditions apply to all orders placed by a client (as defined below) and to all sales conducted by Steambot GmbH (“Steambot” or “Seller”) of any product made available by Steambot (collectively referred to as the “Products”). Additional terms may sometimes accompany the Products; however, in the event of any inconsistency, these Terms and Conditions shall take precedence.

By purchasing a Product—whether the order is placed by phone, through the Steambot website (steambot.us), in person, or through any other method, and whether or not it follows a quotation—the client accepts that these Terms and Conditions of Sale (“Terms and Conditions”) govern the agreement between Steambot and the client. These Terms and Conditions override any alternative provisions provided by the client. Steambot’s failure to contest any client communication that includes differing terms shall not be interpreted as acceptance of those terms.

The term “Client” refers to any individual or entity placing an order with Steambot.

1.4
These Terms and Conditions of Sale replace any pre-printed conditions appearing on the client’s purchase orders, as well as any prior oral or written statements made by either party regarding the Products or the terms of sale. The client may not alter these Terms and Conditions without obtaining Steambot’s prior written approval.

2. SHIPPING

2.1
Steambot reserves the right to decline sales and/or delivery in certain regions worldwide. Shipments may not be possible to some remote areas. Steambot may cancel or refuse any order where there is no commercially reasonable shipping option available, and shall not be held liable to the Client for such cancellations. In such cases, Steambot will refund any amounts already paid by the Client.

2.2
All Steambot machines are shipped within United States. Customers in remote regions may incur additional delivery fees.  The Client is responsible for all applicable sales taxes, goods and services taxes, harmonized sales taxes, duties, and similar charges related to the order. 

2.3
Orders received Monday through Friday during normal business hours are generally processed within 24 hours. Orders placed on weekends are processed the following Monday. 

2.4
The Client must ensure availability to receive the shipment within 1–10 days after order confirmation.

3. RISK OF LOSS OR DAMAGE AND DELIVERY

3.1
Ownership of the Product transfers to the Client once full payment has been received. The risk of loss or damage to the Product passes to the Client on an “ex works” basis from Steambot’s facilities.

3.2
Any delivery or shipment dates communicated by Steambot are to be considered estimates only. Steambot shall not be held responsible for any loss, damage, expense, or cost arising from a failure to deliver according to the estimated delivery or shipment schedule.

4. RETURNS

4.1

All sales are final, subject only to the return policy outlined below.

4.2

For purchases made through commercial leasing or financing, all sales are final and this return policy does not apply.

4.3

If the Client is dissatisfied with the Product, the Client must notify Steambot within 30 days from the delivery date. The Product must then be shipped back within 7 days of receiving the Return Shipping Label, and the tracking number must be provided to a Steambot representative by email without delay. Failure to return within the specified timeframe or to provide tracking information may result in denial of the return request.

5. LIMITED WARRANTY

5.1
For a period of twelve (12) months from the date of purchase (the “Warranty Period”), if the Client has operated the Product under normal conditions and strictly in accordance with the instructions and/or user manual provided by Steambot, and a defect in materials or workmanship is discovered and reported in writing to Steambot during the Warranty Period, Steambot will use commercially reasonable efforts to repair or replace the defective portion of the Product, refund the purchase price, or provide a replacement Product or part thereof.

If the Product cannot be repaired, Steambot may provide a refurbished equivalent unit, a comparable replacement, or a store credit equal to the current value toward the purchase of a new Product. In the event Steambot exchanges the covered equipment, ownership of the original Product transfers to Steambot, while the replacement Product becomes the Client’s property, covered for the remainder of the original Warranty Period.

5.2
The warranty shall be considered void under the following circumstances:

a) if the damage results from accident, misuse, freezing, impact, unauthorized use, alteration, force majeure, or the use of electrical supply other than that specified on the Product;

b) if repairs, modifications, or alterations are carried out by anyone not authorized by Steambot;

c) if the owner or user fails to perform the routine maintenance required, and the damage or issues are directly attributable to such neglect. It is the Client’s responsibility to maintain the equipment in proper working condition and to use only Steambot-approved cleaning products in order to avoid damage to the internal components.

6. FORCE MAJEURE

For the purposes of this Agreement, force majeure shall include, but is not limited to: acts of God, war, mobilization, government regulations, strikes, lockouts, droughts, floods, total or partial fire, obstruction of transportation routes, loss, damage, or detention during transit, defective materials, delays caused by carriers, or any other unforeseen events or causes beyond the Seller’s reasonable control that may hinder the manufacture, shipment, or delivery of the Goods covered herein.

In the event of force majeure, the Seller’s performance obligations may be suspended for the duration of such circumstances, without the Seller being held liable to the Client for any damages or losses arising from the suspension.

7. WEBSITE USE, CONTENT & COPYRIGHT

7.1
This website, steambot.us (the “Website”), and all its content are the exclusive property of Steambot. By visiting or making purchases on the Website, you agree to these Terms of Use and undertake not to use the Website in any illegal way or in any manner that could harm Steambot, its affiliates, or partners. Steambot may revise these Terms of Use at any time without notice. Continued use of the Website means you accept such changes.

7.2
All logos, text, graphics, images, videos, sound, and their arrangement on this Website belong to Steambot and are protected by intellectual property laws. No content may be copied, reproduced, sold, modified, or distributed in any form without Steambot’s prior written consent. You may view and print content from the Website only for personal, non-commercial use.

8. INTELLECTUAL PROPERTY

8.1
The Client agrees that any invention, patent, industrial design, copyrightable material, website content, or object, as well as any technical, scientific, marketing, or commercial know-how or trade secret related to the Product (collectively referred to as “Industrial Property”), shall remain the exclusive property of Steambot.

8.2
The Client acknowledges and accepts that all trademarks used in connection with the Product, whether registered or unregistered (the “Trademarks”), are the sole property of Steambot.

8.3
The Client shall not take any action that could invalidate or compromise any Trademark or registration thereof, impair Steambot’s rights, or create adverse rights against Steambot. Without limitation, the Client shall not, during the term of this Agreement or thereafter, adopt, use, register, or attempt to register in any jurisdiction any trademark that incorporates or is confusingly similar to the Trademarks.

8.4
No element of this Website shall be construed, expressly or implicitly, as granting a license, right of use, or duplication of any Trademark, except with the prior written consent of Steambot or another rightful owner of such Trademark. Steambot enforces its intellectual property rights to the fullest extent permitted by law.
